About Service Agreements in the State of Florida
Service Agreements sold to the consumer in the State of Florida are regulated by the Florida Department of Insurance. Florida State Law addresses these regulations in chapter 634, Part III, Service Warranty Associations. Below are a few license requirements that are in place to protect YOU, the consumer:
- Maintain cash deposits and / or surety bonds to ensure performance
- Maintain sound financial stability
- Report to the State, quarterly, all service agreements sold and premiums collected
- Submit to audits by the Department of Insurance every two to three years
- Hold all premiums in escrow, to be allocated on a monthly basis
- Hold 25% of all premiums collected until the expiration date of the service agreement
These stringent requirements are the reason that few companies are properly licensed to offer service agreements in the State of Florida.
